What Is Family Law Mediation?

Mediation is a confidential, cooperative process in which a neutral mediator helps the parties communicate, identify areas of disagreement, and explore possible solutions.

The mediator does not represent either party and does not make decisions for the family. Instead, the mediator guides the discussion and helps the participants work toward agreements they can both accept.

Mediation may be used to address issues including:

  • Division of property and debts

  • Child custody and parenting time

  • Child support

  • Spousal maintenance

  • Post-divorce disagreements

  • Changes to existing parenting arrangements

  • Other domestic and family law disputes

When an agreement is reached, its terms can generally be documented and submitted to the court for approval when required.

Mediation gives the parties an opportunity to participate directly in creating a resolution. Depending on the circumstances, mediation may offer several advantages:

What Is Family Law Arbitration?

Arbitration is another form of alternative dispute resolution, but it differs from mediation in an important way. Rather than helping the parties negotiate their own agreement, a neutral arbitrator reviews the information and arguments presented and makes a decision regarding the disputed issues.

The process can be less formal and more flexible than a traditional court proceeding. Depending on the parties’ agreement and applicable law, an arbitrator’s decision may be binding and subject to only limited court review.

Family law arbitration may be appropriate when the parties want a knowledgeable neutral to decide specific issues but would prefer to avoid some of the delay, formality, or public nature of courtroom litigation.

Mediation or Arbitration: Which Is Right for Your Family?

The best approach depends on the nature of the dispute and the parties’ ability to work together.

Mediation may be a good option when both parties are willing to negotiate and want to retain control over the outcome. Arbitration may be useful when the parties are unable to reach an agreement but want a qualified neutral to decide the disputed issues outside a traditional trial.

Some matters may also benefit from a combination of approaches. The parties might resolve several issues through mediation and use arbitration or court proceedings for the remaining disagreements.

Each family’s circumstances are different. Before choosing a dispute-resolution process, parties should consult with their own attorneys to understand their rights and determine which approach may be appropriate.
